General Condition

Chapter 1 General Article 1 [Purpose] The purpose of these terms and conditions is to stipulate the rights, obligations, and other responsibilities between Rakso Holdings Co., Ltd. (hereinafter, referred to as "Company") and user in relation to the use of the internet services provided through the Philippine Airlines Internet Website (hereinafter, referred to as "www.philippineair.co.kr") operated by the Company.

Article 2 [Definition of Terms]

  1. ① "www.philippineair.co.kr" refers to a virtual place of business that the Company has set up to enable the trade of goods using information and communication equipment such as computers to provide goods or services to users.
  2. ② "User" refers to a member, non-member, or newsletter subscriber who accesses the internet site www.philippineair.co.kr and receives services provided by the Company in accordance with these terms and conditions.
  3. ③ "Member" refers to a person who provided personal information to "www.philippineair.co.kr", as a member and is entitled to the information and services continuously provided by the Company through www.philippineair.co.kr.
  4. ④ "Non-member" refers to a person who uses information and services provided by the Company without joining membership.
  5. ⑤ A "Newsletter Subscriber" refers to a member who periodically receives advertisements or public relations information about the Company products for marketing purposes.
  6. ⑥ "Operating Agency" refers to a company affiliated with the Company and is responsible for booking, issuing, and consulting of airline tickets at www.philippineair.co.kr.
  7. ⑦ "Personal Information" refers to the information that can identify a specific individual by his/her name, e-mail, and so on included in the information (including information that may not identify a specific individual by itself, however, may in combination with other pieces of information.)

Article 3 [Notification and Revision of Terms and Conditions]

  1. ① The Company shall announce the contents of these terms and conditions, company name, contact information, and address of the company’s place of business on the initial service screen of the Company’s website (www.philippineair.co.kr). However, details of the terms and conditions may be presented to the user through a linked screen.
  2. ② The Company may revise these terms and conditions within the extent of not violating related laws such as the Act on the Consumer Protection in Electronic Commerce, Etc., the Act on the Regulation of Terms and Conditions, the Framework Act on Electronic Documents and Transactions, the Digital Signature Act, the Act on Promotion of Information and Communications Network Utilization and Information Protection, Etc., the Act on Door-to-Door Sales, Etc., and the Framework Act on Consumers.
  3. ③ In case of revising terms and conditions, the Company shall specify the revised contents, reason for revision, date of application, etc. and announce it on the initial screen of www.philippineair.co.kr together with the current terms, and the announcement period shall be at least seven days prior to the date of application.
  4. ④ The revised terms shall be applied to the members who joined before the revision of the terms unless they violate related laws and regulations in the Republic of Korea after announced in the same manner described in the preceding paragraph. However, if the member explicitly expresses his/her intention of refusal against the revised terms and conditions by the application date of the revised terms and conditions, only the terms and conditions before the revision shall be applied to the member.

Article 4 [Regulations other than Terms and Conditions] Matters not stipulated in these terms and conditions and the interpretation of these terms and conditions shall be subject to related laws and regulations such as the Act on the Regulations of Terms and Conditions, the Act on the Consumer Protection in Electronic Commerce, Etc., and the Framework Act on Consumers.

Chapter 2 Use of Service Article 5 [Provision of Service]

  1. ① Company provides the following services through www.philippineair.co.kr.
    1. 1. Reservation of airline ticket and related services
    2. 2. Provision of travel information and travel product related information
    3. 3. Introduction to services provided by the Company
  2. ② When necessary, the Company may change the contents of the service provided in the preceding paragraph by adding and adjusting the service as deemed necessary.

Article 6 [Use of Service and Limitations]

  1. ① The service shall be available 24 hours a day, seven days a week.
  2. ② The Company may temporarily suspend the provision of services in the event of maintenance, replacement, or breakdown of information and communication equipment such as computers, system malfunction, communication loss, and so forth.
  3. ③ The Company does not indemnify the user or any third party for damages caused by the discontinuation of services due to the reasons stated in Paragraph above, however, this shall not apply in the case of intentional or gross negligence.
  4. ④ Part of the internet services provided by the Company may be provided only for members of www.philippineair.co.kr.
  5. ⑤ The Company may shut or suspend the use of the service without prior notice if the user has engaged in any of the following;
    1. 1.Conduct against public order or morals
    2. 2.Any act presumed to be related with a crime
    3. 3.Act of planning the use of or using services with the intention of harming public interest
    4. 4.Stealing another person’s ID and password
    5. 5.Act of defaming of insulting others or other acts intended to harm others
    6. 6.Double registration using more than one ID
    7. 7.Act of hampering the wholesome use of services such as interrupting the provision of services.
    8. 8.Act of violating the rules of use set forth in other related laws or Company's terms and conditions
  6. ⑥ If the use of the service is suspended due to one of the reasons listed under the preceding paragraph, the Company shall not be held responsible for any damages caused therefrom for the user.

Article 7 [Joining Membership]

  1. ① User subscribes by completing a sign-up form provided by the Company with his/her information and expressing his/her consent to the terms and conditions.
  2. ② When the user presses the "Accept" button on the screen, it is deemed that the user agrees with the contents of these terms and conditions, and by this he / she shall also become a member of www.pilippineair.co.kr. However, minors under 14 years of age may apply for membership by agreeing to these terms and conditions with the consent of their legal representatives.
  3. ③ Anyone who wishes to become a member shall register with his/her real name and provide personal information as requested by the Company.
  4. ④ Anyone who falls under any one of the following cannot become a member.
    1. 1.User who has applied for a membership with someone else’s name.
    2. 2.User who gave false information on the membership application form in whole or in part
    3. 3.Has not been three years from the date the user was disqualified in accordance with Paragraph 2 of Article 8 of these terms and conditions
  5. ⑤ When a change is made in membership information, the member shall reflect the change directly through the <Change Membership Information> in order to keep the information updated.
  6. ⑥ All information provided through the membership application form is regarded as true, and any disadvantage caused by not providing or not changing actual information shall be shouldered by the member.
  7. ⑦ You can subscribe to the newsletter by subscribing to the newsletter subscription menu at www.philippineair.co.kr by providing personal information requested by the company and agreeing to the use of your personal information.

Article 8【Member ID and Password】

  1. ① Members who wish to use the homepage service must register their member ID and password on the company website as indicated by the company.
  2. ② Members are responsible for the management of ID and password; members shall not give their ID and password to a third party or allow a third party to use them.
  3. ③ If a member becomes aware that his/her ID or password is stolen or is being used by a third party, he/she should notify the company immediately and follow the instructions of the Company.

Article 9 [Withdrawing from Membership and Loss of Qualification]

  1. ① Members who desire to withdraw can simply withdraw from membership at any time through the member withdrawal feature in My Page of www.philippineair.co.kr.
  2. ② Newsletter subscribers can unsubscribe by requesting cs@philippineair.co.kr to unsubscribe.
  3. ③ If a member falls under any of the following, the Company may restrict the use of services by the member or cancel his or her membership.
    1. 1.Member's death
    2. 2.In case of false information or double registration using two or more IDs
    3. 3.If the user interferes with other people’s use of services or engages in fraudulent activities such as stealing other people’s information
    4. 4. If the user refuses to pay for the ticket purchased through www.philippineair.co.kr or if the user uses the service provided at www.philippineair.co.kr and fails to clear the corresponding liabilities
    5. 5. If the user commits acts prohibited by these terms and conditions, violate laws, or commit any other violations of public order through www.philippineair.co.kr
    6. 6.If the member who received an ID on the homepage has no record of logging on to the company's homepage and mobile application / website for one year
  4. ③ If it is necessary for the member to lose membership registration as the member was disqualified due to reasons stated in the preceding paragraph, the Company may notify the member in advance to listen to explanations from the member. However, this shall not apply in the case of said Paragraph 2.1.
  5. If the member loses membership or is restricted from the use of the service due to the reasons falling under Paragraph ②, the Company shall not be liable for any resulting damages

Article 10 [Notification to Member]

  1. ① When the Company notifies the member, the Company may use the e-mail address that the member registered to the company to notify, or send letters, make phone calls, or use other methods.
  2. ② If the company notifies an unspecified number of members, it can substitute individual notices by posting at www.philippineair.co.kr for more than 7 days.

Article 11 [Provision of Information] The Company may provide information about various services such as the information about the use of services and various events (commercial advertisement) and travel information for its members and newsletter subscribers by e-mail, letter, or wireless SMS (short message service). However, members who do not wish to receive information may refuse to receive such information provided by the Company.

\Article 12 [Purchase of Airline Tickets]

  1. ① The user may apply for the purchase of tickets and so on according to the method set by www.philippineair.co.kr.
  2. ② The Company may not accept the purchase request of the user in any of the following cases
    1. 1. If there is false information, omission, or omission in the application contents
    2. 2. If approval of the purchase request is not possible according to current law or company regulations
    3. 3. Other cases where the acceptance of the purchase request is technically difficult by www.philippineair.co.kr
  3. ③ The consent of the Company to the purchase request of the user shall be deemed to have been made when the notification confirming the receipt reaches the user.
  4. ④ The user who receives the notification confirming the receipt in the preceding paragraph may cancel the purchase request or ask for change of contents of the request, and the company shall process it accordingly.

Chapter 3 Protection of Information Article 14 [Protection of Personal Information]

  1. ① When collecting information from users, the Company collects only the minimum information necessary for the provision of services and the fulfillment of agreements.
  2. ② Details about personal information protection are subject to the Company's privacy policy and website's privacy policy.

Chapter 4 Responsibilities and Obligations Article 15 [Obligations of Company]

  1. ① The Company shall not commit acts prohibited by laws and regulations and these terms and conditions and shall make its best efforts to provide continuous and stable services as stipulated in these terms and conditions.
  2. ② The Company shall keep personal information, and so forth secure in order to enable users to use the services safely and also take technical safety measures and make assurance to ensure the security.
  3. ③ The Company shall maintain order in electronic commerce through fair and wholesome operations of www.philippineair.co.kr and make efforts to provide high-quality services through continuous research and development.
  4. ④ The Company shall not engage in any illegal labeling or advertising activities as stipulated in Article 3 of the Act on Fair Labeling of Advertising for products or services offered through www.philippineair.co.kr.
  5. ⑤ The sales of goods or services of the affiliated company of www.philippineair.co.kr are performed directly under the responsibility of the affiliated company, and the Company only acts as an intermediary through the site.

Article 16 [Obligations of User]

  1. ① The user must comply with the related laws and regulations, the matters specified in these terms and conditions, other instructions and precautions of the Company, and shall not interfere with other normal operations of the Company.
  2. ② The user must fill out the application form honestly and faithfully based on facts when applying for membership. If there is any reason for change in the information provided, the user must change it based on facts. The user shall be responsible for any problems arising from not making necessary changes.
  3. ③ The user shall not copy, duplicate, change, or use any information obtained during the use of the service for any other commercial purpose without prior consent of the Company.
  4. ④ In addition to the acts of the preceding paragraph, the user shall not engage in any of the following acts;
    1. 1. Change of information posted by the Company in www.philippineair.co.kr
    2. 2. Sending or posting information (computer programs, etc.) other than the information indicated by the Company
    3. 3. Infringing upon intellectual property rights such as copyrights of third parties
    4. 4. Damaging the image, reputation or other activities of third parties.
    5. 5. Disclosing or posting obscene or violent messages, images, voices, or information that conflicts with public order in www.philippineair.co.kr
    6. 6. Selling products or soliciting by using the web boards of www.philippineair.co.kr
    7. 7. Other actions that the Company deems inappropriate
  5. ⑤ If any information on each item of the preceding paragraph is posted or linked to www.philippineair.co.kr and is deemed inappropriate for operating the website, the Company may delete the information or block the link without the consent of the user or other information publisher.

Article 17 [Relationship between www.philippineair.co.kr and Other Websites]

  1. ① If www.philippineair.co.kr and its sub-website are hyperlinked (Ex: Texts, pictures, and videos are hyperlink targets), the Company does not assume liability for warranty for the goods or services independently provided by the sub-website.
  2. ② The Company shall not guarantee the reliability of the information or materials posted on the web board of www.philippineair.co.kr and shall not be held responsible even if damages occur therefrom.

Chapter 5 Other Article 18 [Copyright Ownership]

  1. ① Copyrights and other intellectual property rights belong to the company.
  2. ② The user may not use information obtained through www.philippineair.co.kr, particularly the information to which the Company’s intellectual property rights belong, for commercial purposes or for use by third parties by the method of copying, transmitting, publishing, distributing, broadcasting or otherwise, without the prior consent of the Company.

Article 19 [Resolution of Dispute]

  1. ① The Company shall operate an exclusive CS Team in order to reflect legitimate opinions and complaints raised by users and to compensate for damage.
  2. ② If the user has complaints about the use of www.philippineair.co.kr operated by the Company or wishes to suggest opinions, the user may do so through the website's e-mail or by telephone.

Article 20 [Jurisdiction and Governing Law]

  1. ① The Company and the user shall make all necessary efforts to ensure that disputes arising out of the use of services are resolved mutually.
  2. ② Notwithstanding the efforts in the preceding paragraph, if a lawsuit is filed, the Seoul Central District Court shall have jurisdiction over the case and the law of the Republic of Korean shall be applied to the case.

Article 21 [Effect of Terms and Conditions] These terms and conditions shall be effective from March 1, 2017 and be applied to members who joined membership through the website prior to the enforcement of these terms and conditions. As a rule, the revised terms and conditions are also applied to agreements concluded before the effective date.
